TarmTorbThese terms are an agreement between you and the individual who provides TarmTorb (“we”). By creating an account or using TarmTorb, you accept them. If you use TarmTorb for an organization, you accept them for that organization too.
1. Your account
- You must be an adult, and able to accept these terms for yourself or your organization.
- Give your real name and an email address you use, and keep your password to yourself. You are responsible for what happens in your account.
- An organization’s owners decide who joins it and what each member may do. They are responsible for what their members do in the organization.
2. Using TarmTorb fairly
Don’t use TarmTorb to:
- show, share or collect anything illegal, or anything that infringes someone else’s rights, such as copyright, trademarks or privacy
- harass, threaten or hate others, or show sexual content involving minors in any way
- send spam, run scams, or trick people into giving personal or payment details
- collect sensitive personal data, such as health or religion, through join forms
- attack, overload or break TarmTorb, try to reach other organizations’ data, or work around limits and security measures
- copy TarmTorb or resell it without our written agreement
Players can report a game to us from their phone. We may remove content, end a game, or suspend an account that breaks these terms, without notice when the harm is serious. Tell us at help@tarmtorb.com if you think we got it wrong.
3. Your content
What you create, such as quizzes, images and brand material, remains yours. You let us store, copy and show it, only as far as we need to run TarmTorb for you and your players. You must have the rights to everything you upload or link to, including images, logos and videos.
4. Copyright and trademark complaints
If you own the rights to something shown in a quiz or game on TarmTorb, or act for whoever does, and its use wasn’t allowed, email us at help@tarmtorb.com with:
- what the work or trademark is, and that you own it or act for its owner
- where it appears, such as the game’s PIN or link, or the quiz’s name
- your name and how to reach you
- a statement that you believe in good faith the use isn’t allowed, and that what you tell us is accurate
When a complaint has these details, we remove the material or block access to it promptly, and tell the organization that added it. If they believe we got it wrong, they can reply with their reasons, and we may restore it. In appropriate cases, we close the accounts of those who infringe again and again.
5. Your players’ data
When you collect details from players, you are their data controller, and we process their data for you. You must have a lawful basis for what you collect, give players any notice the law requires, and answer their requests. Our privacy notice explains how we handle personal data.
6. Limits
Each organization has limits, such as the largest game and the storage for images. We may change limits with reasonable notice. Fair use of TarmTorb is expected even within the limits.
7. Price
TarmTorb currently costs nothing. If we start charging for it, we will tell account holders at least 30 days before, and you can choose whether to continue.
8. Availability
We work hard to keep TarmTorb running, especially during events, and the status page shows its state. But we can’t promise it will always be available or free of errors, and we may change, add or remove features. We tell you in advance about planned changes that matter.
9. Other services and trademarks
Some features use other companies’ services, such as YouTube clips, our LINE Official Account, and signing in with LINE, Google or Apple. Their own terms apply to them. TarmTorb plays YouTube clips in YouTube’s embedded player, using YouTube API Services: by using TarmTorb, you agree to be bound by the YouTube Terms of Service.
QR Code is a registered trademark of DENSO WAVE INCORPORATED. LINE is a trademark of LY Corporation. YouTube, Google and Google Sheets are trademarks of Google LLC. Microsoft Excel is a trademark of the Microsoft group of companies. Apple is a trademark of Apple Inc. TarmTorb is not affiliated with or endorsed by them.
10. Ending
You can stop using TarmTorb at any time, and ask us to delete your account. We may suspend or end your account if you break these terms, or if the law requires it. Owners can download their organization’s results before an organization is deleted.
11. Liability
TarmTorb is provided as it is. To the extent the law allows, we are not liable for indirect losses, such as lost profits or a disrupted event, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that Thai law does not allow to be limited.
12. Changes to these terms
When we change these terms, we update the date at the top, and tell account holders by email at least 30 days before important changes take effect. If you keep using TarmTorb after that, you accept the new terms.
13. Law
These terms are governed by the laws of Thailand, and the courts of Thailand decide any dispute about them. If the Thai and English versions differ, the Thai version prevails.
